On 15th November 2018, the General Court of the Court of Justice of the European Union (ECJ) annulled the European Commission’s State aid approval for the UK Capacity Market, ruling in favour of the complainant, Tempus Energy. The ruling means the Capacity Market enters a standstill period, which prevents the UK Government from holding any capacity auctions, making any capacity payments under existing agreements, or undertaking any other action which could be seen as granting State aid, until the scheme can be approved again.

On 11th December, in Room C, 1 Parliament Street, PRASEG hosted a discussion and Q&A between Jillian Ambrose, Energy Editor at the Daily Telegraph, Sara Bell, Tempus Energy Founder and CEO and Lawrence Slade, CEO of Energy UK. The discussions focussed on:

  • The details of the case and the ECJ ruling;
  • Near-term implications for the Capacity Market and UK energy security; and,
  • Longer-term implications for Capacity Market design and the contribution of DSR technologies.
